Termsof service.

Terms applicable to private investigation, private security and DuoTrack services. Read carefully before signing a mandate or placing an order.

Preamble

These General Terms and Conditions (T&C) govern services provided by Duo Guardians Sàrl, Rue du Bourg 40, 1816 Chailly/Montreux, Switzerland (UID: CHE-409.746.668). Any order, mandate signature or use of our services implies full acceptance of these T&C.

1. Services offered

Duo Guardians offers three distinct service lines:

  1. Private investigations: surveillance, missing persons, background checks, due diligence, investigations for individuals, companies, lawyers and insurers.
  2. Private security: close protection, VIP escort, secure transport, executive protection. Activity subject to CES.
  3. DuoTrack: GPS antitheft tracking system for premium vehicles (hardware installation and monthly subscription).

2. Quote and mandate

Every investigation or security mission is subject to a written quote and a signed mandate before execution. The quote details:

  • Mission scope and objectives
  • Methods used
  • Estimated duration
  • Associated fees (hours, travel, operational)
  • Report delivery terms

The initial consultation (30-minute advisory meeting, on site or by phone) is free and without commitment.

3. Legal framework

All our missions are conducted in strict compliance with Swiss law, particularly:

  • Swiss Civil Code (Art. 28 et seq., personality rights)
  • Federal Data Protection Act (revised FADP)
  • Concordat on Security Companies (CES)
  • Swiss Code of Obligations (CO)

No method prohibited by Swiss law is used. Any mission that would exceed the legal framework (e.g., intrusion, illegal eavesdropping, characterized invasion of privacy) will be refused.

4. Pricing and billing

4.1 Private investigators

  • Hourly rate: CHF 120.- excl. VAT
  • Travel fees: CHF 0.70/km outside the canton of Vaud
  • Operational fees (unmarked vehicle rental, surveillance equipment, etc.): billed at cost with prior agreement
  • Deposit: 50% upon mandate signature, balance upon report delivery

4.2 Private security

  • Close protection (static): from CHF 95.-/hour
  • Mobile close protection: from CHF 1,200.-/day
  • VIP escort: from CHF 1,000.-/day
  • Executive protection: from CHF 1,500.-/day
  • Secure transport: pricing per dispatch

4.3 DuoTrack

  • Discreet installation: CHF 300.- (one-time)
  • Monthly subscription: CHF 10.-/month
  • Minimum commitment: 12 months

Swiss VAT at 8.1% in addition where applicable. A detailed invoice is issued at the closure of each mission.

5. Confidentiality

Duo Guardians is committed to absolute confidentialityon all missions. Investigators and agents are bound by a contractual confidentiality clause whose breach engages their personal liability.

No information is disclosed to a third party, except in two strict cases:

  • Judicial requisition by a competent Swiss authority (judge, public prosecutor)
  • Express written authorization from the client

6. Deliverables

Each investigation mission concludes with the delivery of a written report, chronological, factual and signed. The report may be accompanied by:

  • Timestamped photographs
  • Videos with metadata
  • Screenshots and supporting documents
  • Summary usable by your lawyer or counsel

Deliverables are provided in secure digital format (encrypted) or on paper upon request. A copy is archived for 10 years (legal duration).

7. Limitation of liability

Duo Guardians commits to a best-efforts obligation, not an obligation of result. The company cannot be held responsible for:

  • The absence of results if material conditions (environment, target behavior, weather constraints) do not allow them
  • The use the client makes of the report (proceedings, mediation, private dialogue)
  • The interpretation that third parties (judge, expert, opposing counsel) might make of documented elements

8. Cancellation and termination

  • The client may cancel a mission up to 48 hours before the planned start, without fees
  • For late cancellations (less than 48h), already-incurred costs (preparation, rentals, agent mobilization) are due
  • Duo Guardians may refuse or interrupt a mission that would exceed the legal framework, without penalty
  • For DuoTrack: subscription cancellable at any time with 30 days notice after the minimum commitment period

9. DuoTrack vehicle theft procedure

In case of theft of a DuoTrack-equipped vehicle, the client contacts the police directly (117) and provides them with the GPS coordinates from the application. Duo Guardians is not a 24/7 operations center and does not intervene physically. Upon judicial requisition, Duo Guardians provides the location history.

10. Complaints

Any complaint must be addressed in writing to info@duoguardians.ch or by mail to the registered office, within 30 days following report delivery or service completion. We commit to respond within 14 business days.

11. Jurisdiction and applicable law

Any dispute related to these T&C is subject to Swiss law exclusively. Before any legal action, the parties shall attempt an amicable resolution. Failing this, the exclusive jurisdiction is Montreux, canton of Vaud, Switzerland.
